Timothy Sargeant

EXPERIENCE:

Timothy is a commercial litigation and corporate insolvency specialist with over 20 years'
experience. He has extensive experience advising and assisting clients in a wide range of
commercial and civil matters and disputes. He also acts for several insolvency practitioners in addition to advising private clients on insolvency related issues.

After graduating from the University of Sydney with a Bachelor of Arts (majoring in Latin) and a Bachelor of Laws with First Class Honours, and prior to joining Landerer & Company as a Special Counsel, Timothy worked for some of Australia's leading law firms, including Freehills (now known as Herbert Smith Freehills), Corrs Chambers Westgarth and Mills Oakley. He has also been a Partner at a boutique law firm and a Director at a national mid-tier law firm.

Timothy understands the importance of not only providing sound legal advice, but also
sound business advice, and has a reputation for exceptional commitment to client service.

Timothy's expertise includes alternative dispute resolution, contract disputes, disputes
involving claims and defences under the Corporations Act, finance default proceedings,
including recovery of security, appointment of receivers, realisation of assets and mortgagee sales, and insolvency matters, including advising administrators and liquidators.

Timothy is a Solicitor Member of the Law Society of New South Wales and a Professional
Member of the Australian Restructuring Insolvency & Turnaround Association.

Outside of work, Timothy enjoys travelling, dining with friends, the cinema and trying to keep up to date with the many excellent television shows on the various streaming devices. Having attained his AMusA in piano when he was 16, Timothy also maintains an interest in classical music and tries to attend as many Opera Australia productions as he can.

Acted for ANZ and its receivers, Ferrier Hodgson, in Supreme Court of South Australia auditors’ negligence proceedings commenced against PwC and EY, the former auditors of the Harris Scarfe group of companies.

Acted for and advised Bedford CA, a firm of Chartered Accountants, in Federal Court proceedings in respect of its alleged involvement in the cross-border misappropriation of assets. 

Acted for Dawson & Partners, a firm of Chartered Accountants, in multi-party Federal Court proceedings and an ASIC investigation in respect of misleading and deceptive conduct inducing investors to invest in IRexchange Limited (In Liquidation).

Acted for ERG Limited in Supreme Court of New South Wales proceedings commenced by the New South Wales Government in respect of the failed Tcard project.

Acted for Fuji Xerox Australia in relation to a contractual dispute with a major Australian bank following the bank’s termination of a significant project relating to the digitisation of cheque processing services.

Acted for and advised Hall Chadwick in relation to a number of corporate insolvency issues and formal appointments.

Acted for and advised Jirsch Sutherland in relation to a number of corporate insolvency issues and formal appointments.

Acted for Macquarie Bank in relation to the potential acquisition of two portfolios of distressed loans from Lloyds International (BOSI and Capital Finance).

Acted for and advised Mad Capital Pty Ltd, the founder of the Mad Mex business in Australia, in relation to Supreme Court of New South Wales proceedings commenced against its Singaporean investor, 4Fingers International Pte Ltd.

Acted for the NSW Police Force in relation to a number of claims made by and against former and current NSW Police officers.

Acted for the late Cardinal Pell and the Catholic Archdiocese of Sydney in respect of issues before the Victorian Parliamentary Inquiry into the Handling of Child Abuse by Religious and Other Organisations and the Royal Commission into Institutional Responses to Child Sexual Abuse.

Acted for Perpetual in first instance Supreme Court of New South Wales and New South Wales Court of Appeal proceedings commenced against the liquidators of HIH Holdings (N.Z.) Limited (In Liquidation) in respect of their rejection of an unsecured creditor’s claim made by Perpetual on behalf of a number of convertible note holders.

Acted for Vodafone Hutchison Australia in Federal Court proceedings commenced by its main provider of network managed services, Nokia Siemens Networks, in respect of network accessibility issues.
